These Terms & Conditions ("Terms") govern your access to and use of the Lumo mobile applications and website (the "Platform"). By using the Platform, you agree to these Terms.
1. About Lumo
Lumo Rideshare Inc. ("Lumo," "we," "us," or "our") operates a Transportation Network Company (TNC) platform connecting riders with independent drivers in Ontario, Canada.
Lumo provides a technology platform only. We do not provide transportation services directly.
Drivers using the Platform are independent contractors and are not employees, agents, or representatives of Lumo.
2. Eligibility
To use the Platform, you must:
- Provide accurate and complete account information
- Comply with all applicable laws
- Agree to these Terms
We reserve the right to suspend or terminate accounts for violations.
3. Account Registration
You are responsible for:
- Maintaining confidentiality of login credentials
- All activity occurring under your account
- Providing accurate information
4. Fare Calculation & Pricing
Fares are calculated based on:
- Time and distance traveled
- Pickup and drop-off locations
- Operational cost factors
Additional charges may apply:
All fares are tax inclusive.
Pricing adjustments may occur with advance notice where required by applicable regulations.
5. Payment
Where required by municipal regulations, payment may be required prior to trip commencement to confirm total fare.
Payments are processed through third-party payment providers.
Lumo does not store full credit card information.
6. Receipts
Electronic receipts are issued via the Platform and sent to the email associated with your account.
7. Refusal of Service
Drivers may refuse service where reasonably justified, including:
- Threatening or abusive conduct
- Safety concerns
- Refusal to state destination
- Refusal to comply with payment requirements
All refusals must comply with the Ontario Human Rights Code. Discrimination is prohibited.
8. Accessibility
Lumo complies with the Accessibility for Ontarians with Disabilities Act (AODA).
Drivers must accommodate service animals and mobility devices as required by law.
9. Driver & Vehicle Standards
Drivers must:
- Hold a valid Ontario G driver's licence
- Maintain required insurance coverage
- Pass background screening
- Hold valid TNC licensing
Vehicles must meet Ontario Safety Standards.
10. Insurance
Drivers must maintain:
- Minimum $2,000,000 CAD liability coverage
- Appropriate rideshare endorsement
11. Limitation of Liability
To the maximum extent permitted by law, Lumo is not liable for:
- Actions or omissions of independent drivers or riders
- Delays, cancellations, or service interruptions
- Loss or damage to personal property
Nothing in these Terms limits liability where prohibited by law.
12. Indemnification
You agree to indemnify and hold harmless Lumo from claims arising from your misuse of the Platform or violation of these Terms.
13. Intellectual Property
All content, trademarks, logos, and software on the Platform are the property of Lumo Rideshare Inc. and may not be copied or used without permission.
14. Suspension & Termination
We may suspend or terminate accounts for:
- Violations of these Terms
- Fraudulent activity
- Safety concerns
- Regulatory requirements
15. Changes to Terms
We may update these Terms periodically. Continued use of the Platform constitutes acceptance of updated Terms.
16. Governing Law
These Terms are governed by the laws of Ontario and Canada.
