Terms of Platform Use
Lumo Rideshare Inc.

These Terms of Platform Use ("Terms") form a legal agreement between you and Lumo Rideshare Inc. ("Lumo", "we", "our"). They apply when you access or use the Lumo mobile applications, website, or related services (collectively, the "Platform").
By using Lumo, you agree to these Terms.
1. Nature of the Platform
- Lumo provides a digital marketplace that enables users to request and offer transportation services.
- Lumo does not operate as a transportation provider. Trips are carried out by independent drivers who use the Platform.
- Nothing in these Terms creates an employment, partnership, or agency relationship between Lumo and any driver.
2. Who Can Use Lumo
To access the Platform, you must:
- Be at least 18 years old
- Provide accurate and current account information
- Use the Platform in compliance with applicable laws
We may restrict or deactivate access if these conditions are not met.
3. User Accounts
When creating an account:
- You are responsible for safeguarding your login credentials
- You accept responsibility for all activity under your account
- You must keep your information up to date
Lumo is not responsible for unauthorized access resulting from your failure to secure your account.
4. Pricing & Trip Charges
Trip costs are determined through the Platform using a combination of factors such as time, distance, and real-time conditions. Depending on how a trip is used, additional charges may apply, including:
- Time-based waiting beyond a short initial period
- Requests involving multiple stops
Final pricing is shown within the app before a ride is confirmed. Lumo may adjust pricing models over time, with notice where required.
5. Payment Processing
Lumo facilitates electronic payments through third-party providers. By requesting a ride, you authorize Lumo to charge your selected payment method for all applicable fees.
For certain trips, a pre-authorization or upfront charge may be required before the ride begins.
6. Trip Documentation
After each completed trip:
- A digital summary is generated
- A receipt is sent to the email linked to your account
It is your responsibility to review trip details and report any issues promptly.
7. Acceptable Use & Conduct
All users must behave respectfully and lawfully. Drivers may decline or end a trip if:
- There is a concern for safety
- A rider engages in inappropriate or disruptive behavior
- Platform rules are not followed
Discrimination of any kind is strictly prohibited and must comply with Ontario human rights laws.
8. Accessibility Commitment
Lumo supports accessible transportation and operates in alignment with Ontario accessibility legislation. Drivers are expected to:
- Accommodate riders with disabilities where reasonably possible
- Accept service animals in accordance with legal requirements
9. Driver Participation Requirements
Individuals using Lumo as drivers must:
- Hold a valid Ontario driver's licence
- Provide required documentation (vehicle, insurance, identity)
- Successfully complete screening checks
Drivers are responsible for maintaining compliance with all licensing obligations.
10. Vehicle Requirements
Vehicles used on the Platform must:
- Be safe, roadworthy, and properly maintained
- Meet applicable inspection standards
- Have operational safety equipment, including seatbelts
Failure to meet standards may result in removal from the Platform.
11. Insurance Responsibility
Drivers are required to maintain valid insurance coverage appropriate for rideshare activity, including minimum liability limits required under Ontario law.
12. Service Interruptions & Liability
The Platform is provided "as is" and "as available." To the extent permitted by law, Lumo is not responsible for:
- The conduct of drivers or riders
- Trip delays, cancellations, or availability issues
- Loss or damage to personal belongings
Nothing in these Terms excludes liability where prohibited by law.
13. Responsibility for Use
You agree to be responsible for your use of the Platform and any consequences arising from misuse. You agree to indemnify Lumo against claims resulting from:
- Violations of these Terms
- Improper use of the Platform
- Breach of applicable laws
14. Ownership of Platform Content
All intellectual property associated with Lumo, including branding, software, and content, remains the exclusive property of Lumo Rideshare Inc.
You may not copy, reproduce, or use any part of the Platform without permission.
15. Account Restrictions
Lumo may limit, suspend, or terminate access to the Platform where necessary, including for:
- Safety concerns
- Fraud or misuse
- Legal or regulatory requirements
16. Changes to These Terms
We may update these Terms periodically. Updated versions will be posted on the Platform.
Continued use after updates means you accept the revised Terms.
17. Applicable Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.
